About Entheos Network

This Privacy Notice applies to the website located at Entheos.network (“Site”) owned and operated by Entheos Operations, Inc. (“we” or “Entheos Network”) and to the services that Entheos Network provides to its clients (“Service(s)”).  Entheos Network is an energy storage services platform that provides energy storage related services to web and mobile users and partner applications along with various associated financial and economic services.  This Privacy Policy is applicable to all Site visitors, registered users, customers and all other users of the Site and Services. This Privacy Policy describes how Entheos Network collects, uses, shares and secures your personally identifying information on the Site and through the Services. Personally identifying information, as used herein, means any information that identifies or relates to a particular individual and also includes information referred to as “personally identifiable information” or “personal information” under applicable data privacy laws and regulations. This Privacy Policy also describes the choices available to you regarding the use of your personally identifying information by Entheos Network and options available to you to access your information and request correction or deletion should you choose to do so.

Entheos Network does not send unsolicited emails or sell any personally identifying information users may have submitted to us through the Site or Services. In addition, for lead generation or marketing purposes, we may ask individuals interested in obtaining more information about Entheos Network products to voluntarily submit their contact information to us. By accessing and using the Site and/or the Services, or by otherwise providing us with personal information, users acknowledge that they understand our Privacy Policy and expressly consent to our collection, use and disclosure of personal information in accordance with this Privacy Policy. If any user does not agree to the terms of this Privacy Policy, please do not use the Site or Services.

Information Collected or Tracked by Entheos Network

Information Submitted to Entheos Network by Users and Customers

Entheos Network receives user-submitted information from registered users of the Site and Services and from users wishing to be sent additional promotional information on Entheos Network products. Personally identifying information (generally referred to as personal information herein) so collected would include information such as name, phone number, company, title, unique identifiers such as passwords, account name and email address. With respect to payment information, Entheos Network will typically collect information such as payment card type, payment card number, billing address and phone number. Entheos Network may also collect information regarding a user’s purchase history and consumer profiles depending upon the product being accessed.

Information Submitted to Entheos Network by Candidates for Employment

As part of its recruiting activities, Entheos Network also receives personal information from users submitting job application materials to be considered for Entheos Network employment (“Recruiting Data”). This Recruiting Data includes anything that an individual chooses to include in a resume or application, and typically consists of job history, education, personal interests and activities, name, email address, phone number, and residence address. Further, Entheos Network collects gender, race, and military status from employment candidates to assist Entheos Network in its equal employment opportunity compliance and related statistical tracking to help our diversity efforts. In connection with job screening activities, Entheos Network also requests personal information sufficient to have background checks conducted prior to hiring.

Information Indirectly Submitted by Users to Entheos Network

We also use cookies and collect some information passively such as the client browser type, device ID, domain server, Media Access Controller address and IP address information. This information is gathered for all users of the Site and Services to track usage and provide a personalized experience. The information collected may also encompass available web analytics, metadata, and geolocation data when available on a product specific basis. Information Collected from Other Social Media Sites

Entheos Network collects data about individuals that is made available to Entheos Network and other third parties by social media sites such as Twitter, Facebook, Instagram, LinkedIn, YouTube, and others through APIs or social media monitoring technology. This data includes names, user IDs, social media handles, gender, and other information that individuals choose to make publicly available on social media sites. Entheos Network may also monitor the public activities of individuals on social media sites, including posts, blogs, tweets, and profile information including such social media messages directed at or referencing Entheos Network in order to better understand our customers and to serve them better.

Information Collected through Advertising Partners

We may also collect information from our advertising partners who assist us with marketing or promotional services related to how you interact with the Site, Services and related applications, products, advertisements and communications.

Use of Information Obtained by Entheos Network

Information collected by Entheos Network is used to provide the Services to our users and to fulfill our obligations according to the Entheos Network Terms of Service and individual agreements entered into with clients and users. Information gathered is also used to: (i) communicate with users about the Services, including Service announcements, updates or offers; (ii) create and manage your account or other user profiles and provide operational support for provisioning the Services; (iii)  personalize website content and communications based on your preferences, including targeted offers and ads served through the Services; (iv) process orders or other transactions; (v) improve and develop the Services, including testing, research, analysis and product development; (vi) protect against or deter fraudulent, illegal or harmful actions and maintain the safety, security and integrity of our Services; (vii)  respond to a user's request for additional information on Entheos Network Services; (viii) provide, develop, enhance and support related Entheos Network Services; (ix) fulfill Entheos Network’s legal obligations and defend Entheos Network’s legal rights or resolve disputes as needed; and (x) for any other business purpose stated when collecting your personal information or as otherwise set forth in applicable data privacy laws, such as the California Consumer Privacy Act (the “CCPA”) and the General Data Protection Regulation (the “GDPR”) applicable to users in the EEA. We may also use a user's email address to send promotional or marketing materials on related Services, such as updates on the Entheos Network product line, but this is only after the user is a registered client, Service is requested by the user, or Entheos Network has some other pre-existing business relationship with the user. We use your IP address and browser-type information in the general administration of our website.

In regards to candidates for employment, we use your Recruiting Data for purposes of evaluating candidates for potential employment with Entheos Network. Entheos Network processes your personal information on the basis of its legitimate interests in overseeing the recruitment process and, if applicable, your employment relationship with Entheos Network. For residents of EEA countries, when this requires us to transfer your personal information outside of the EEA, we comply with applicable EU data privacy rules.

Sharing of the Information the Site and Services Gather or Track

As a matter of policy we do not sell your personally identifying information. We may disclose your personally identifying information only in ways that are described in this Privacy Policy as stated below:

  • To any third party with your consent
  • To companies that provide support and other services to Entheos Network on our behalf to help us with business activities. These companies are authorized to use your personally identifying information only as necessary to provide these services to us. The service providers we share information with include payment processors, ad networks, security and fraud prevention consultants, hosting and other technology and communications providers and analytics providers. These services may include hosting, log file analysis, spam filtering, content delivery network services, fraud detection and monitoring or serving targeted in-media content.
  • In certain situations, Entheos Network may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements, when required by law to comply with a subpoena or other similar legal processes
  • When we believe in good faith that disclosure is necessary to protect our rights, your rights, protect your safety or the safety of others, investigate fraud, or comply with a law enforcement request
  • If Entheos Network becomes involved in a merger or acquisition, or any form of sale of some or all of its assets, we will provide notice via email and/or a prominent notice on our website when your personally identifying information becomes subject to a different privacy policy, of any change in ownership, uses of your personal identifying information, and choices you may have regarding your personal identifying information.
  • We disclose your personal information to various companies that partner with us regarding the offering of our Services.  These partners include businesses that you have a relationship with and companies that we partner with to offer joint promotional offers and operational opportunities.
  • In regards to Recruiting Data, we disclose Recruiting Data to employees and service providers who have a need to know such information in order to conduct recruiting and the employment activities described above.  For EEA data subjects personal information, in connection with the recruitment process, we may transfer your personal data outside of the EEA to our appropriate subprocessors, which provide applicant tracking and background services. Such service providers comply with the EU-U.S. Privacy Framework and ensure that your personal information is adequately protected whilst outside of the EEA.

Subject to the terms of this Privacy Policy, we may disclose information to our employees, contractors, affiliates, vendors, partners and suppliers who process information on our behalf, participate with us in the provision or operation of the Services or provide you with services.

We may email you about products and services that we believe may be of interest to you if you’ve provided us the means to do so. If you wish to opt-out of receiving marketing materials from us, please follow the instructions at the bottom of each email for opting out or send a request via email to privacy@entheos.network.

We may allow partner advertisers to choose the demographic information of users who will see their advertisements and/or promotional offers and you agree that we may provide any of the information we have collected from you in an anonymized non-personally identifiable form to a partner advertiser, in order for that partner advertiser to select the appropriate audience for those advertisements and/or offers.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Use of Cookies and other Tracking Technologies

Cookies or similar technologies are used by Entheos Network and our partners, affiliates, or analytics or service providers. The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs, and JavaScript (collectively, “cookies”) to track customer traffic patterns, to maintain a connection during your visit with us, to track your preferences, and to diagnose problems on our server and administer the Site.  These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

We partner with a third-party ad networks to either display advertising on the Site or to manage our advertising on other websites. We display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at marketing@entheos.network.

Access to Your Personally Identifying Information (pii)

Entheos Network acknowledges that you have the right to access your personal information. Upon request Entheos Network will provide you with information about whether we hold any of your personal information collected via this Site. You may access, correct, or request deletion of your personal information collected via this Site by emailing us at privacy@entheos.netowrk. We will respond to your request within a reasonable timeframe.

Security of Your Personally Identifying Information

We follow generally accepted industry standards to protect the personally identifying information submitted to us, both during transmission and once we receive it. Choices and Opt-out Options

Users have the opportunity to “opt-out” of having their personally identifying information used for certain purposes such as receiving promotional or other marketing material from us during the registration process for downloading a whitepaper or signing up for our webcasts and with respect to promotions, programs, location-tracking services or contests. Additionally, users who no longer wish to receive our updates or newsletters may opt-out of receiving these communications by following the instructions contained in the mailer or by emailing us at privacy@entheos.network. Correcting and Updating Personal Information

Users have the right to receive a copy of and/or change your information at any time and as often as necessary via by contacting us at: privacy@entheos.network. You can also request that the data be changed or deleted (requests for deletion of certain information may require closing the account) by emailing us at privacy@entheos.network.

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to request a notice identifying the categories of personal information which Entheos Network shares with its affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties. California Residents Rights

If you are a California resident, you have the rights outlined in this section. Regarding how to exercise these rights we require that you provide notice containing sufficient information to allow us to verify that you are the person about whom we have collected Personal Data and adequately describe your request in sufficient detail to allow us to understand, evaluate, and respond to it.  Please submit your request to privacy@entheos.network for further consideration. Our normal response time for such requests is within forty five (45) days.

Right of Access:  As a California resident, pursuant to the provisions of the CCPA, you have the right to request certain information about Entheos Network’s collection and use of your personal information over the past twelve (12) months. We will provide you with the following information: (i) the categories of personal information that we have collected about you; (ii) the categories of sources from which that personal information was collected; (iii) the business or commercial purpose for collecting or selling your personal information; (iv) the categories of third parties with whom we have shared your personal information; (v) the specific pieces of personal information that we have collected about you. Additionally, if we have disclosed your personal information for a business purpose over the past 12 months, we will identify the categories of personal information shared with each category of recipient.

Right of Deletion:  You have the right to request that we delete the personal information that we have collected from you. Under the CCPA, this right is subject to certain exceptions: for example, we may need to retain your personal information to provide you with the Services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request.

Data Retention

We will retain your contact information for as long as your account is active or as needed to provide your Services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Data Protection Under the GDPR for EEU Residents

If you are a resident of the European Economic Area (“EEA”) and you are using the Services, the GDPR will apply to our processing of your Personal Data.  If the GDPR applies to you, you may have additional rights with respect to your Personal Data (as defined in the GDPR), as outlined below.   If you would like to delete your information and the GDPR applies to you, please contact us at privacy@entheos.network.

The Services, including the Site, are hosted and operated in the United States (“U.S.”) through our US operations and our service providers. When you use our Service, personal information of users processed by Entheos Network will be transferred to the U.S., where our primary processing facilities are located, and possibly to other countries where we or our service providers operate. These transfers will often be made in connection with routing your communications in the most efficient way. By your use of the Services, you acknowledge that any Personal Data about you is being provided to Entheos Network in the U.S. and will be hosted on U.S. servers. This is necessary for us to process your order and provide the Services to you pursuant to our Terms of Service or any individual agreement we have with you.

Data protection law (including privacy law) in certain jurisdictions, like the EEA, differentiate between “controllers” and “processors” of personal information. When Entheos Network collects and processes your information, we generally act as a controller. For example, we may need to use certain customer usage data for the legitimate interests of billing, reconciling invoices with telecommunications carriers, and in the context of troubleshooting and detecting problems with the network. In doing so we act as a controller of that information.

When the information is transferred to one of our service providers, they act as a processor of that information and must follow Entheos Network instructions regarding their processing activities. Entheos Network employs appropriate safeguards for cross-border transfers of personal data, as required by applicable data privacy law, including Standard Contractual Clauses to cover transfers to service providers outside the EEA. Entheos Network also enters into a Data Protection Agreement with each service provider to address and flow down all appropriate required data privacy legal obligations. When we transfer your Personal Data we will take all reasonable steps to ensure that your privacy rights continue to be protected consistent with our obligations under data privacy law.

We will only process your Personal Data if we have a lawful basis for doing so. Lawful bases for processing include consent, contractual necessity and legitimate interest of Entheos Network and others. We process Personal Data associate with your account as a matter of contractual necessity, meaning that we need to process the data to provide you with the Services. We process certain categories of Personal Data when we believe it furthers the legitimate interest of us or third parties including: (i) improvement of our business, products and services; (ii) marketing of our products and services; (iii) customer support; (iv) to protect against and address fraud or security threats; and (v) to satisfy legal obligations. We may also process Personal Data based on the consent you expressly grant to us at the time we collect such data.  When we process Personal Data based on your consent, it will be expressly indicated to you at the point and time of collection.

Under the GDPR EEA residents have various rights with respect to the Personal Data that Entheos Network processes.  These rights include: (i) the right to access your Personal Data (“Access”); (ii) the right to request transmission of your Personal Data (“Data Portability”); (iii) the right to correct or supplement any inaccurate or incomplete Personal Data (“Rectification”); (iv) the right, subject to limited exceptions, to request that we erase some or all of your Personal Data from our systems on certain grounds more specifically set forth in the GDPR (“Erasure”); (v) withdrawal of prior granted consent (“Consent Withdrawal’); (vi) objection to processing for marketing purposes; and (vii) the right to file a complaint with the appropriate supervisory authority. This Privacy notice may change from time to time, so please review it frequently for any updates or changes. If we make material changes to this notice we will notify you by email (sent to the e-mail address specified in your account) or we will place a prominent notice on the Site prior to the change becoming effective. Entheos Network reserves the right, in its sole discretion, to revise, amend, or modify this Privacy Policy at any time, and in any manner without notice. Your use of the Site or Services following such notification constitutes your acceptance of the terms and conditions of this Privacy Policy as modified.
